Terms And Conditions

RUSTICA  TiILES hereafter known as “the Company” in the following conditions).

1. Terms of Payment. Unless specified to the contrary all invoices are due for payment in full on day of order. No goods will be ordered until a minimum 50% deposit is paid. No orders will be released until paid in full and all payments have cleared.

a) Full payment of invoices for services supplied are required within  7 days.

b) Where work is not complete through no fault of our own, payment is expected up to date, based on hourly rate or m2 completed, within 7 days.

C) Should payments not be received within time period set above for services provided, Rustica hold the right cease works until payments are satisfied

d) Extra Materials. Credit/Debit card details are taken as security in the event of extra materials being required for preparation of sub bases, or extra material being required to complete a project; we reserve the right to charge the value of any goods required to the credit/debit card given. This is to enable same day or next working day delivery of any extra goods required as to not delay installation, which would otherwise incur the client substantial labour costs. We will in all cases endeavour to notify the client before making any charges to their card, however in the event of the client not being available we reserve the right to charge for any goods required for immediate dispatch.

e) Discount and Late Payment. If payment in full or part is outstanding after 14 days of collection/delivery, we reserve the right to withdraw any discounts given and invoices will be due immediately in full.

f) Interest Rate. We reserve the right in any event to claim interest at 10% per month from the date of invoice.

2. All Goods are the property of the Company until cleared funds are received in full.

2.a The Company has no responsibility to undertake the provision of any Goods or Services to the Client until cleared funds have been received by the Company for the whole of the agreed price.

2.b Where payment is made via credit or debit card, this does not automatically constitute payment of cleared funds. If the Client is uncertain whether payment of cleared funds has been made, they should contact the Company to request confirmation.

2.c If payment is made by cheque, the Company will not process the order until the cheque has been paid into the bank and it confirmed as cleared funds in accordance with the UK bank cheque clearing process.

2.d Where payment is made by way of electronic bank transfer or monies paid directly into the bank account of the Company, it is the responsibility of the Client to inform the Company that this payment has been made.

2.e The provision of any Goods or Services offered will be undertaken once confirmation of any such payment is received by the Company through verification with the bank

3. Prices are subject to alteration without prior notice. Our price list and any price displayed in our showroom or on the company web sites are given as guide only, and in no circumstances does it constitute an offer to sell our products at the published price by our own or any of our stockiest company’s.

4. Delivery/Quotations are given in good faith in light of delivery position and subject to availability of materials. Every effort will be made to effect delivery within the quoted period, but no liability or claim for costs can be accepted should it be exceeded.

5. Quotations are based on current costs and are subject to amendments on or after acceptance to meet any recognized rise in such costs. Such rises will apply at date of invoice/dispatch irrespective of date ordered. Quotations are based unless otherwise stated, on our current range of stock.

6. Order Cancellation. Non stocked items; we cannot accept cancellation of orders once placed. The right is reserved to refuse cancellation of orders in case of goods in the process of manufacture, ready for dispatch, in transit and collected / delivered.

6.a Bespoke Orders cannot be cancelled once placed without the Client being liable for any and all costs and charges related to the Bespoke Order

7. Conditions of Order. In the event of any customer’s official order form containing any special conditions, it is understood that such conditions are only binding in so far as they are not of any variation with the terms and conditions mentioned herewith, unless specifically accepted by us in writing by a company director.

8. Credits. We cannot accept goods for credit where goods have been correctly supplied to the order. Irrespective of responsibility for quantities ordered. Where, however, we agree voluntarily to such a return, a handling charge of 30% plus any necessary transportation cost will be charged.

9. Quantities and Short Delivery Claims. No claim for short delivery can be entertained unless signified at the time of delivery. Customer’s signature on delivery notes accompanied by remarks such as “unexamined” or similar will not be binding to the Company. Please note in most cases more goods then ordered will be delivered, for contingencies breakages in transport etc; these surplus goods will remain the property of RUSTICA and may be collected by a company representative any time after delivery.

10. Damaged Goods. No claim for damaged goods can be entertained unless signified at the time of delivery. Any claim must be received in writing at the above company’s official office within 48 hours of receipt of goods. No claim for unboxed goods will be accepted unless signified on time of delivery, only then will valid claims for damaged goods be considered for replacement. If replacement pieces are required the damaged goods must be returned to us before replacement goods can be dispatched.

11. Crazing and Shading. No tiles or fittings can be guaranteed against crazing or shading. The Company reserves the right to refuse any complaint or reasonability for any products once these said goods have been fixed, as all goods should be carefully inspected before fixing. The use of goods implies their acceptance by the Customer

11.1 Natural materials vary in colour, texture, tone, finish and dimensional accuracy from piece to piece at any one time and over time from the same source. Samples, photographs, displays and other descriptions can only provide an indication of the aesthetics, dimensions and mechanical characteristics. They should not be relied on as an exact match to the current available material.

12. No Sale or Return. No tiles, stone or ancillary materials can be supplied on a sale or return basis. Calculations and Quantities should be checked by yourselves or your fitter before placing an order, as we take no responsibility for any surplus or shortages of goods required., even if a RUSTICA representative calculates and estimates quantities required, as the layout of installation can greatly effect the percentage required for waste and we have no control over the accuracy of any drawings, specifications or sizes given and used for calculations.

13. Site Deliveries. Site deliveries are only undertaken on the understanding that purchaser will be responsible for the offloading the goods and storing the same to prevent theft or damage from weather etc. Orders must be greater than 200 Kg. We reserve the right to decline a site delivery. Drivers will make one delivery attempt to a site. Please note due to the nature of the products involved all orders will be made by large wheel base vehicles between 12 & 18 tonne. If special instructions are required for delivery due to weight or width restrictions the company must be notified at the time of estimating or ordering, in this case we reserve the right to apply surcharges for deliveries where a smaller 7.5 tonne lorry or van is required to carry out the delivery.

14. Existing Walls & Flooring. All flooring and wall areas to be tiled should be ready to receive new wall & floor tiles materials. Unless specified in writing, our fixing estimates and invoices do not include labour, plant or materials to take up old wall or floor covering or to prepare walls and flooring. If any labour, plant or materials is needed to prepare the walls or floors a day rate and material price will be incurred.

15. Rubble & Packaging. On completion of installation works by our fixers any rubbish and rubble will be bagged up in rubble bags and left tidally on site with any pallets and packaging. The fixers may be able if requested to remove or arrange removal of waste material; however this cost is not included in our estimate or invoice unless stated in writing and this will incur an extra charge, please ask us for prices.

16. Specifications, Sizes and Colours. All colours, sizes and specifications given are approximate, this is normal with handmade and natural products, which may vary considerably; they are indicative only and should not be regarded as precise. Specifications are correct at time of publication but may change thereafter.

17. Qualities and Use. Suggestions for uses of tiles do not indicate that they will never show signs of wear when used for that purpose.

18. Samples Shown & Supplied. Samples are indicative only, stone and tiles will very from tile to tile and batch to batch. No two tiles or stones are the same; considerable variation is normal and is to be expected

19. Natural Stone, Slate & Terracotta. Any product in our range of natural wall and flooring may have minor chip, blemishes and imperfections, which will not be accepted as faulty. This is usual for this type of product and can enhance the appearance when installed; any tiles with larger imperfections should be used for cuts.

20. Templates & Cutting. If templating is deemed necessary a charge will be applicable, our minimum day rate is £250.00, but the cost is variable depending on the type and extent of templating required, the cost will be confirmed prior to work commencing. We reserve the right to refuse templates supplied by others, as accuracy of the template cannot be guaranteed. If we accept to use a template or templates supplied by others, in any the event of variations we will take a centre line of any cutting variations. All materials manufactured from templates are subject to the following tolerances + or – 2mm.

21. Goods Delivered or Collected. The Company reserves the right to refuse any reasonability for materials supplied incorrectly or in fact faulty in any way, once these said goods have been fixed, as all goods should be carefully inspected before fixing. The use of goods implies their acceptance by the Customer.

22. Labour & Installation. If you choose to use one of our recommended teams of installers they are to be paid direct.

The company takes no responsibility, profit or gain for labour or works carried out by recommended installers, as the installers will be contracted direct to the client. It is the sole responsibility of the client to make sure the installer has the correct instructions regarding installation procedures and layout. The tiles or stone should be inspected and approved by the client and installer prior to any installation. We advise all clients should be on site to oversee the start of installation and should also oversee the complete installation. Any offer, estimate or quote regarding installation given by the company, is intended as a rough guide only and in no circumstances does it constitute an offer to carry out the installation for this sum. The installer contracted should be asked to confirm all details of the works and his price before any work commences.

23. Acceptance of Terms and Conditions. The purchaser shall be deemed to have accepted these Terms & Conditions of sale and services, without reservation, upon the placing of any order for the supply of goods due for payment in full on day of order and acceptance of estimates issued. No goods will be ordered until a minimum 50% deposit is paid. No orders will be released until paid in full and all payments have cleared.
